Spousal support in Louisiana

Do you live in the state of Louisiana? Are you going through the divorce process? If you answered yes to both these questions, you may want to learn more about spousal support.

There is no guarantee that one spouse will be required to pay the other spousal support; however, this does come into play from time to time.

There are two types of spousal support that can be awarded in Louisiana:

-- Interim spousal support

-- Final periodic spousal support

Interim spousal support is awarded to a person who does not have enough income to maintain his or her standard of living during the divorce process. With this, the goal is to help both spouses maintain the same level of living conditions as experienced during their marriage.

This type of spousal support can last up to six months after the divorce is finalized.

Final spousal support is awarded to a person who has been found by the court to be free from fault in regards to the divorce. It is awarded if the requesting spouse is found to have need and the other spouse is found to have the means to provide financial support.

With two types of spousal support in Louisiana, it can be a challenge to understand what you may be entitled to receive. This is why you should begin to learn more about your options as you begin to move through the divorce process.

Since there is so much gray area, since your former spouse may argue against paying spousal support, it's important to understand the law and to work with a legal professional who can protect your rights.
