Woman crashes into canal and is accused of drunk driving

A woman from Metairie saw her early morning drive come to a quick end when her car left the road, flipped over and landed in a drainage canal. It was upside down, but the woman was able to get out of the vehicle. She is 68 years old, and reports did not indicate if the police arrived and helped her or if she'd already gotten out by the time the emergency response team made it to the crash site.

What is clear is that a witness saw her car sail off the road and flip into the water, and calls where made to police at about 1:30 in the morning.

When the police did get there, reports claim that the woman would not accept medical help. An officer then claimed to smell alcohol on the elderly woman's breath.The officer said she was slurring her words and having trouble standing straight, swaying back and forth.

Police asked her if she'd had anything to drink, and they say she admitted that she had. They then gave her field sobriety tests, which she allegedly failed. Eventually, she said she was having a hard time breathing, so the emergency crews brought her to an area hospital.

The woman would not take a breath test. The officers then asked for a warrant so they could get a blood sample, and they got it. The results of that sample have not been released yet, per the latest reports.

All those who are accused of drinking and driving must know their legal rights, especially when breath tests and blood tests are involved. There are very specific steps that authorities must follow to have any evidence admitted into court.
